A property trust can only be formed whilst both partners are living. Usually, with a couple the property would be divided in to equal shares (50-50), though this can be uneven shares also.
On first death that share would be placed into the trust via the will.
A property trust is suitable for everyone in a relationship to ensure your children will inherit your share of the property, so even if the surviving partner remarries your childrens inheritance is protected.
The survivor has the right to remain living in the property, under the terms of the trust, for the rest of their lives. On second death the trust would come to an end and the property would pass absolutely to your chosen beneficiaries.
YES. if the survivor wants to sell and move to another property the terms of the trust will remain over the new property.
